Terms of Service
Introduction
Welcome to Amor de Mer, an oceanfront villa. By booking and staying at our property, you agree to comply with and be bound by the following terms and conditions. Please read these Terms of Service carefully. If you do not agree with any part of these terms, you may not access or use our services.
1. Booking and Payment
1.1 Booking Confirmation: All reservations are confirmed upon receipt of the full payment or a deposit (as specified at the time of booking). The balance of the payment is due 30 days prior to arrival.
1.2 Rates: All rental rates are subject to change without notice unless a reservation has been confirmed.
1.3 Payment Methods: We accept payment via credit card through our payment processor.
1.4 Taxes and Fees: Local taxes and applicable service fees will be included in the total price of the booking.
2. Cancellation Policy
2.1 Cancellation by Guest: Cancellations must be made in writing via email. The following charges apply:
- Cancellations made more than 60 days before the arrival date: Full refund.
- Cancellations made less than 30 days before arrival: No refund.
2.2 Cancellation by Amor de Mer: In the unlikely event that we need to cancel your reservation, you will be entitled to a full refund. Amor de Mer will not be held liable for any other costs or losses incurred by the guest.
3. Check-in/Check-out
3.1 Check-in: Check-in is from 4:00 PM on the arrival date. Early check-in may be available upon request but is not guaranteed.
3.2 Check-out: Check-out is at 11:00 AM on the departure date. Late check-out requests may be accommodated if possible, but additional charges may apply.
3.3 Key Collection: Key pickup instructions will be provided prior to arrival.
4. Occupancy and House Rules
4.1 Maximum Occupancy: The villa accommodates a maximum of 8 guests. Exceeding the occupancy limit will result in immediate termination of the rental without a refund.
4.2 No Parties: Amor de Mer is intended for quiet enjoyment. Parties, large gatherings, and excessive noise are strictly prohibited.
4.3 Pets: Pets are not allowed unless prior approval has been granted.
4.4 No Smoking: Smoking is strictly prohibited inside the villa. Smoking is permitted in designated outdoor areas.
4.5 Pool Usage: Guests are required to follow safety rules when using the pool. Children must be supervised at all times. Amor de Mer is not liable for accidents or injuries that occur during pool usage.
4.6 Damages: Guests are responsible for any damages to the property or its contents caused by them during their stay. Any damage should be reported immediately. Repair costs may be deducted from the security deposit.
5. Security Deposit
A security deposit of USD$1,000 is required at the time of booking. This deposit is refundable within 7 days of check-out, provided no damages or violations of the terms have occurred during the stay.
6. Liability and Insurance
6.1 Guest Responsibility: Guests are responsible for their own personal belongings and should ensure their valuables are safely secured. Amor de Mer is not liable for any loss, damage, or theft.
6.2 Injury or Loss: Amor de Mer shall not be liable for any accidents, injuries, illnesses, or losses sustained by guests during their stay.
6.3 Travel Insurance: We recommend that all guests purchase travel insurance to cover any potential disruptions, cancellations, or accidents.
7. Force Majeure
Amor de Mer will not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, or government restrictions.
8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Sint Maarten, without regard to its conflict of law provisions.
9. Amendments
Amor de Mer reserves the right to update or modify these Terms of Service at any time without prior notice. Any changes will be posted on our website and will be effective immediately upon posting.
